Utah is considered to be an “equitable distribution” state. Being an equitable distribution state means that any property acquired during the marriage will be divided fairly. A fair division is not necessarily an equal division.

Non-marital property is property acquired before the marriage. Non-marital property may also include gifts or inheritances that are received during the marriage. Generally, each party will keep their own non-marital property.

Questions regarding property distribution will be asked during the initial questionnaire, allowing for you to fill out all divorce papers properly to address such matters.
